This website and online shop (“Nives Zülli Art Shop”) is operated by Nives Zülli (niveszuelli.ch and shop.niveszuelli.ch). Throughout the website, the terms “we”, “us” and “our” refer to Nives Zülli.
Nives Zülli is an artist/illustrator that is specialized in watercolor and ink painting. On this website we sell her artworks and other products. All services on the website and on this online store are offered to you, the user, conditioned upon your acceptance of the T&Cs and the Privacy Policy, which is an integral and binding part of this T&Cs.
1. General terms
By agreeing to these T&Cs, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the T&Cs will result in an immediate termination of your Services.
2. Copyright
Owner of the copyright for images on this website is Nives Zülli. If you share certain images from this website, for example on social networks, you shall indicate Nives Zülli as the creator. You shall not copy paintings or prints for commercial purposes.
3. Private commissions
Besides the purchase of already created paintings, we offer you the possibility to commission a painting. Work orders for private commissions are only considered accepted when we have agreed on the essential elements of the contract (motif, price, payment method, size of the work, painting technique and deadline for the work) and when you have received a corresponding written acceptance.
3. Binding orders
By placing an order on Nives Zülli Art Shop and accepting the T&Cs and the Privacy Policy you make a legally binding purchase offer. As soon as you place an order, the sales contract is thus deemed concluded and you automatically receive a confirmation of your order by email. Please check your spam folder if you have not received an email.
4. Accuracy of orders and costumer account information
You are responsible for ensuring that your provided information is complete and accurate. If you have inadvertently made an incorrect entry, you can contact us at nives.zuelli@gmail.com so that we can correct your information for you. If you have opened a customer account, you can also correct your information via your customer account.
We reserve the right to refuse any order you place with us and to delete registrations that are anonymous or abusive.
5. Prices
All prices are listed in Swiss Francs (“CHF”) and excluding VAT and delivery costs. The prices listed at the time of the conclusion of the contract. The current foreign currency exchange rate at time of payment shall apply.
6. Methods of payment
In order to facilitate the users experience, we offer the following payment methods to purchase on the online shop:
· PayPal payment
· Payment by bank transfer
If nothing else is agreed upon individually, delivery is only made against prepayment.
In case of a private commission, the payment method will be agreed upon individually.
7. On-demand products
Products that are marked with "this is an on-demand product" are placed with our partner Printful. Printful is a company that provides prints on-demand, which is an order fulfillment method where items are printed as soon as an order is made.
8. Shipping
Deliveries are currently available to the following countries: Austria, Belgium, Danmark, France, Germany, Italy, Netherlands, Sweden, Switzerland and USA.
We charge you with shipping costs. Shipments will be dispatched after successful payment.
Based on experience, shipments within Switzerland take 3-5 business days. Deliveries to countries of the EU take about 10 business days and to other countries about 20 business days. Should delivery not be possible after three tries, we reserve the right to withdraw from the contract.
Please note that delivery takes longer when you order an on-demand product (approximately up to 1 month). In this case, the production of the purchased item as well as the delivery is carried out by our partner Printful.
9. Damages and other issues
Please inspect your order upon reception and contact us immediately (within 10 days of receipt) at nives.zuelli@gmail.com if the purchased item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
Note that shipping will be proceeded at your own risk. We are not responsible for delays, nor for damages or losses occurred after shipment.
10. Returns
You have a 30-day right of return.
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
To start a return, you can contact us at nives.zuelli@gmail.com. If your return is accepted, we’ll send you a return shipping address, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.
11. Liability exclusion
In no case shall we be liable for slight negligence and consequential or indirect damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, regardless of the legal reason. Because some states or jurisdictions do not allow the exclusion of liability for slight negligence and consequential or indirect damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

We reserve the right, at our sole discretion, to update, change or replace any part of these T&Cs. It is your responsibility to check out these T&Cs for changes. You are subject to the T&Cs in effect at the time you use our website or/and at the time you place your order.
13. Governing law and jurisdiction
These terms and conditions shall be governed and construed in accordance with the laws of Switzerland. Place of jurisdiction is Basel-Landschaft, Switzerland. Mandatory law remains reserved.
